Terms of Service

These Terms of Service ("Terms") govern your access to and use of the platform operated by Uminber Designs ("Accurate Tender", "we", "us", or "our") at accuratetender.com. By creating an account or using any part of the Service you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.
1.Service Scope
Accurate Tender provides a subscription-based SaaS platform that enables businesses to discover relevant government tenders, manage statutory and bid documents, and engage our operator team to file tenders on their behalf across portal sources including GeM, CPPP, state portals, Railways, and Defence procurement systems.
The Service includes, as permitted by your active package: tender discovery and matching, a document vault, operator-assisted filing, real-time status tracking, support ticket management, and notifications. Feature availability is determined solely by the package you have purchased.
We are a service intermediary. We do not guarantee the award of any tender, the outcome of any bid, or the acceptance of any filed document by a procuring authority. Final tender award decisions rest entirely with the issuing government or public body.
2.Account & Eligibility
To register you must be: (a) at least 18 years of age; (b) authorised to enter into legally binding contracts on behalf of the business entity you represent; and (c) a resident or registered entity within India.
- You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
- You must provide accurate and current information during registration and keep your profile details (GST, PAN, Udyam, DSC, contact person) up to date.
- You must not share account access, sub-let, or resell access to the platform to any third party.
- We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity.
3.Payments & GST
All prices displayed are in Indian Rupees (INR) exclusive of Goods and Services Tax (GST). GST at the prevailing rate (currently 18%) is added at checkout. Your GST-compliant invoice is generated automatically upon successful payment and is available in your dashboard under Billing.
- Payments are processed through our authorised payment gateway (PayU). We do not store your full card or bank details.
- Your plan activates immediately upon payment confirmation. Where payment is marked "Pending" by the gateway, plan activation is withheld until the gateway confirms receipt.
- You are responsible for ensuring the GSTIN recorded on your account is accurate before making a payment. Corrections to invoices must be requested within 7 days of issue via a support ticket.
- Failed transactions are not charged. If an amount is debited and not credited to your plan within 2 business days, contact support with your gateway transaction reference.
4.Refund Policy Reference
Our refund policy is set out in full in our Refund Policy. In summary: plan fees are non-refundable once a tender filing has been submitted through the platform on your behalf. Unused bid credits may be eligible for a pro-rata refund within the window specified in the Refund Policy. Activating a package constitutes acceptance of these terms.
5.User Obligations
As a registered user you agree to:
- Use the platform solely for lawful purposes and in compliance with applicable Indian laws, including the Public Procurement Policy, MSME Act, and GST Act.
- Not attempt to reverse-engineer, scrape, or automate interaction with the platform beyond the APIs we explicitly provide.
- Not upload or transmit content that is defamatory, obscene, infringes third-party intellectual property, or contains malware.
- Not engage in bid manipulation, collusive tendering, or any act that violates the Competition Act, 2002 or the Prevention of Corruption Act, 1988.
- Immediately notify us at legal@accuratetender.com if you become aware of unauthorised access to your account.
6.Document Accuracy & Client Responsibility
You are solely responsible for the accuracy, authenticity, and completeness of all documents you upload to the Document Vault or provide to our operators for filing purposes. By uploading a document you warrant that:
- The document is genuine and has not been tampered with.
- You hold all necessary authorisations to submit that document in connection with a tender.
- The document is current and within its validity period (e.g., DSC, GST certificate, experience certificates).
Accurate Tender performs a cursory review of document formats but is not a certification authority and does not independently verify the authenticity of documents. Any disqualification, penalty, or blacklisting arising from false or incorrect documents furnished by you is entirely your liability.
7.Intellectual Property
All platform software, trademarks, logos, design elements, and proprietary data (including our tender matching algorithms and scoring models) are the exclusive property of Uminber Designs. Nothing in these Terms grants you any ownership interest in the platform.
You retain ownership of documents and business data you upload. By uploading you grant us a limited, non-exclusive licence to process, store, and display your data solely for the purpose of delivering the Service to you.
8.Limitation of Liability
To the maximum extent permitted by applicable law, Accurate Tender, its directors, employees, operators, and agents shall not be liable for:
- Any indirect, incidental, consequential, or punitive damages arising from your use of the platform.
- Loss of profits, loss of contract, or loss of business opportunity related to any tender outcome.
- Platform downtime, data loss, or service interruptions resulting from events beyond our reasonable control, including third-party portal outages, government system changes, internet disruptions, or force majeure events.
- Decisions made by procuring authorities regarding tender eligibility, technical evaluation, or award.
In no event shall our aggregate liability exceed the total amount paid by you to us in the three calendar months immediately preceding the event giving rise to the claim.
9.Suspension & Termination
We may suspend or terminate your access immediately if you breach these Terms, engage in fraudulent conduct, or if required by law enforcement or a court order. You may close your account at any time by contacting support. Upon closure, your data is retained per our Privacy Policy retention schedule, after which it is deleted.
10.Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Ahmedabad, Gujarat. The language of arbitration shall be English.
Notwithstanding the above, either party may seek injunctive or other equitable relief in the courts of competent jurisdiction in Ahmedabad, Gujarat.
11.Amendments
We reserve the right to update these Terms at any time. Material changes will be notified via in-platform notice or email at least 7 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. The current version is always accessible at accuratetender.com/terms.
